Terms of Use, Subscription Agreement, Privacy and Solicitation Policies

Membership and Development

The NETWORK has been developed as a "FREE-FLOW INFORMATION SOURCE" FOR THE PURPOSE OF CONDUCTING HUMANITARIAN AID AND DISASTER RELIEF and REBUILDING PROGRAMS. It is open to all. The NETWORK is an opt-in membership ONLY program. The NETWORK develops its  "mail list" via Internet websites, social networks, meetings with service clubs, businesses,  publicly available sources, past database files ,and other avenues. The NETWORK does not purchase mail lists.

The NETWORK contacts individuals, businesses, clubs, and groups with a simple "invitation for NETWORK membership" and an explanation of benefits. Those contacted receive an invitation to Opt-in or Opt-out. Once in the NETWORK,  members are entitled to a free-flow of information with other members, both commercial and non-commercial, to perpetuate development of humanitarian aid and disaster relief projects. The NETWORK has no official affiliation with any service organization, though employees and/or volunteers are free to be members of any organization they choose. 

Developing a Project with NETWORK Resources

Any member, whether a group, individual, service organization, charity, or business entity of any kind may develop a Project or Program Specific CHANNEL to promote their cause, mission, enterprise or venture. The Channel then becomes the point of contact for that member. It is not necessary for members to have a Channel to benefit from the NETWORK. A member may simply choose to participate with other members, form partnership projects, source goods and services, post information about a specific event, project or fundraising program, or use the network to enhance their programs and projects.

Members are free to choose any number of NETWORK and NETWORK member services such as the Resource Development; CO-OP Shipping program for savings in shipping costs; propose or request Civilian-Military help for their particular project; explore new avenues of project-specific, long-term funding and sustainability, or grant funding from sources listed and advertised freely on the NETWORK or NETWORK MEMBERS Portals.

Organizations and their supporters / members, may elect to have specific Channels to communicate within their group and with other groups, and to promote their cause, program, and project. The Organizational Specific Channel, also known as a  Resource Guide, can be established with both short and long-tern On-Line Virtual Project and Program Events, and other activities necessary to find partners for projects, impact funding, or as a social network. Major funding for such events is provided by organizations interested in providing  goods, services, expertise, or partnership opportunities. Channel members participating in such programs tell their story and seek those interested in their cause.

To further facilitate project development, project entities may wish to support the NETWORK by sponsoring NETWORK Member's NEWSLETTERS, which will be developed from time to time along with other NEWSLETTERs, which will inform NETWORK members of specific events of NETWORK members, announce new member resources, and to "tell the story" of successful projects, completed events, or other noteworthy news. Such stories and noteworthy news will also be promoted and/or discussed on the NETWORK Members' BLOG RADIO CHANNEL and the NETWORK Members'VIDEO CHANNEL

Project and Program CHANNELS and other Member CHANNELS may establish links to Other NETWORK Members' CHANNELS to further develop their programs and  projects, and/or may choose to have links to outside sources such as YouTube , other social enterprises, e-mails, and websites. We encourage Network Members to participate in EVERY POSSIBLE media avenue to publicize their projects and programs.

Example of a Typical  Organization -Specific Channel

Resource Channels will be developed by the staff at the NETWORK working closely with the Organiztions Leadership and other NETWORK members that provide resources and services  for programs and  projects.  Here is an example:

A. The Organization selects a Disaster Preparedness Program for its  Project.

B. Leadership  announces the  project to supporters and members, followed up with a letter detailing the program.  To better implement the program to supporters / members, most organizations should have a volunteer/appointed individual to oversee the program

C. The letter is then posted on the web-channel front page, and becomes the focal point when NETWORK members and/or outside visitors  visit the Organization's Channel. The web-channel front page would feature: Website links, Points of Contacts, Links to the Network Blog Radio and Video Channels, You Tube, or other social network locations, or directly to commercial suppliers of goods needed for the project. There would also be a link to the Organization's own "DONATION" web pages link for charitable contributions . 

D. The Leadership Team  can then send a note to other Leaders  to come see their   Program and invite them to join-in or replicate it for their organization or area,  if they are in a disaster zone or looking for a program for their own area or to support.

E. A Designated Network Member Services Provider may send a news release regarding this "POSTING" to other network members, including the announcement of  any possible fundraising activities/events that the organization may be doing to fund the project (gala events and on-line auctions), inviting others to consider participation. There will be no direct solicitation for financial support; others interested in the program would have to go the Organization's Channel and follow links to the financial aspects and needs of the program or project if they choose to become financially involved. It is the choice of the visitor/viewer as to whether to support the cause or not to support the cause.

The only difference in The  Network over the Internet websites and social networks, is that The Network deals with humanitarian aid and disaster relief and similar endeavors of its members.

Disaster Relief Aid Calls to Action

When a disaster occurs there is usually a "Call-to-Action" request made by somebody within hours of the occurrence.  As Network membership involvement is strictly voluntary and open to ALL, it can play a vital role in helping to organize and communicate relief needs.  Many organizations may forbid direct solicitation of its membership by other members regardless of the circumstances, however, service organizations have no authority over non-member entities or commercial enterprises which are often needed to source goods and services. Additionally, if a member opts-in to the Network, that member will be treated as a "member" and as a "member of some other organization".

When disasters occur, time is of the essence. Many may feel the need to respond and feel there is little time for delay. The traditional "First Responders", heretofore the militaries of the US, NATO and others, along with the National Guard Bureau of International Affairs State Partnership Program (NGBIA-SPP), will be essential in most relief efforts. Many individuals involved in military units are in fact members of service organizations. The NETWORK has developed  a Civilian-Military Specific Channel, as a resource for Network members. Additionally, The NETWORK has a listing of several hundred commercial enterprises with the goods and services needed for the disaster response. Using The NETWORK to announce the "call-to-action",  on the Disaster Relief Channel in which efforts at relief can move forward like other Channels on The Network. Each event may become its own CHANNEL. The Network or a Network Member may make available to members and those involved in humanitarian relief efforts an online data base to better coordinate all activity.

Our program to handle disasters will be as follows:

Once notification of a disaster is received, it can be posted under the DISASTER CHANNEL and become the Front-Page "Project" of the Channel. It has been suggested the NETWORK work closely with all groups, to foment a response and allow NETWORK members to take appropriate action in the areas that are appropriate.

The NETWORK is not in the business of collecting funds nor does The NETWORK want the responsibility for collecting any monies. The NETWORK is the facilitator of putting together partnerships for disaster relief and is to be used as a resource.  Network Members may engage in all relief efforts approved by their leadership.

If funding is  needed to purchase goods and services, it is the responsibility of those requesting the relief, to provide an appropriate banking or collection source which can accept financial support.  On the Project Channel , website links may be provided to Resources for the relief efforts.

Requests to use The NETWORK Member's  back-haul shipping partners for relocation of goods will be most welcome. Logistics play a big role in the response effort. Additionally, calling upon The CO-OP Shipping Program Partners to provide cost-effective shipping of goods needed in the relief effort seems appropriate as well. Such requests should be made directly through links we will establish on the Project Channel  Often, such as the recent South Pacific Disasters, many of The NETWORK members put together their own response. Partnering in such cases to facilitate the shipment of many groups makes sense.

Network members and organizations may not solicit funds on The Network Site. They may use their own site and /or Channel to seek support.

We would discourage any member from using our outbound e-mail system for making a plea for money. Instead, it would seem to be in order and more than appropriate to provide General Notification Alerts to individuals, service organizations and others, by all necessary media...The NETWORK Newsletter mechanism, You Tube, Facebook, and all other social networking groups. The alert would direct attention to their own site /or Channel  so action can be taken in whatever form one chooses.

The Network can provide periodic updates and information concerning other disaster relief agencies and groups, including our monitors or direct communications via Twitter and You Tube which we will post on the NETWORK Blog and broadcast on the NETWORK Blog Radio and Video Channels.

PRIVACY POLICY FOR USERS OF WEBSITES OPERATED BY CASPIO Users

OUR PRIVACY PRINCIPLES

Because your trust and confidence is important to us, Caspio conducts its Caspio services under the following privacy principles:

CASPIO ACTS AS AN AGENT FOR OUR CUSTOMERS

Caspio acts as an Agent for each of our Customers, in that we provide our services solely for the benefit of the customer. Each of our customers uses Caspio services to collect data, or to provide information to their websites visitors; they use our services to create and operate database-powered web forms and applications. Each customer instructs us as to what types of data it would like us to collect on its behalf. This data may include the information you explicitly enter in web forms including personally identifiable information, or data implicitly collected through visiting a webpage or logging in to a password-protected area. We also collect certain technical information, such as the browser version and operating system. In each customer agreement, we promise that we will not make use of any data that we collect on the customer's behalf except as necessary to provide our services to that customer. We do not aggregate, sell, transfer, or otherwise disclose it to anyone but the customer, or pursuant to the customer's instructions. We do, however, reserve a limited right to disclose any data we collect if required by law or valid order of a court or other governmental authority.

OUR CUSTOMERS' USE OF CASPIO SERVICES

We ask each of our customers to abide by all applicable laws, rules and regulations, as we promise our clients that we will do ourselves. We also recommend that each customer obtain all necessary consents from visitors to its website(s), post an online privacy policy that provides each visitor with notice of its data collection and use practices (including the customer's use of Caspio's services), and provide a link to the Caspio's privacy policy.

USE OF COOKIES AND OTHER DATA COLLECTION METHODS

In providing services to our customers, it is Caspio's policy to use cookies only when necessary to maintain the identity of the user in a given session. The cookie information does not include personal data such as name, age, phone number, e-mail address or mailing address. Most browsers are initially set up to accept cookies. If you would prefer, you can set your browser to reject cookies, however this may interfere with your usage of some of the services offered by Caspio's customers. Caspio's customers use customized JavaScript code provided by Caspio to contact Caspio's servers, to receive a form or application, to load an image or content, or to submit and update information.

The Humanitarian Network Subscription and  Hold Harmless Agreement

Use of and/or registration on The Network implies acceptance of the below listed terms and conditions. All users of The Humanitarian Network agree to hold harmless The Humanitarian Network, and any individual or entity  acting as an agent or volunteer for the above listed entities.

SUBSCRIPTION SERVICES AGREEMENT

Important - This agreement governs your access to and use of The Network. I (we) understand this program and service is provided to Individuals by Individuals and seeks no endorsement from and has no affiliation with  any  service organization, fraternal order, or charitable enterprise. It’s sole purpose is to provide information which may be useful in conducting international service projects, disaster relief, and providing pertinent information to an organization/s leadership. Registration on this site indicates that organizations or individuals representing registered organizations have read and accept the terms and conditions of this agreement and other policies stated on this site.

1. Agreement.

This Subscription Services Agreement is made between The Network (TN) and ______________________________________________________________(Subscriber) The term of this agreement shall be for a period of one year from the date hereon, and continually renewed annually at the pleasure of both parties, unless terminated by either party in writing.

2. Services.

TN and its Members shall provide meaningful network links, resource services, project support, fundraising assistance, and other such services to aid all involved in humanitarian services, humanitarian aid projects, disaster relief efforts, and usual day-to-day org business. TN is an information provider only.

3. Fees. (Service Clubs / Members, Fraternal Organizations, Individuals, NGOs, Faith-Based Groups, and other entities designated by (TN): Enrollment is free to the aforementioned groups.

4. User's Representations and Warranties:

You represent and warrant to us that (a) you are at least 18 years old; (b) you have the right, power and authorization necessary to enter into and perform this  Services Agreement; and (c) that you will comply to all laws, rule or authority for use, collection, transmission and storage of personal information on the Internet.

5. License to Use the Services. Permitted Uses.

a. Subject to the terms and conditions of this Agreement and upon subscription, TN grants you a non-exclusive, non-transferable license to access and use the  Services solely for educational, research, and personal uses for the term of the agreement.

b. Unless you have obtained separate express permission from TN, you may not use the material (as defined in Paragraph 7 below), except for your own personal, educational, non-commercial use of the site, and in connection with the  Services. See the Terms of Use for details on your rights to limited distribution of material. You may not otherwise transmit, post, copy or redistribute, or use in any other way.

6. General Terms of Use and Privacy Policy applicable to The Network Website.

a. Please read the separate Terms of Use and Privacy Policy which will be posted on our Website for additional terms, as well as details on how you may use the website.

b. The Terms of Use and Privacy Policy apply to the website and  services as a whole.

7. Ownership of the Services and Website Content.

All content, organization, graphics, design, compilation, technology and other matters related to the Network Services and related website content (individually and collectively "material") are the property of TN, or its suppliers or contributors, and protected under applicable U.S. and international laws of copyright, trademark, and other proprietary rights, including but not limited to intellectual property rights.

8. Submissions.

You are responsible for any information or material you or your  entity submit for publication on the website. You represent and warrant that you have all necessary permissions to submit such material, and that our use (including without limitation, to reproduce, display, distribute, modify or create collective works) is likewise permitted, and shall not infringe any third party rights.

9. No transfer or assignment.

Your right to use Network Services is not transferable except to members of your organization or entity on whose behalf you may be registering. Otherwise, any password or right given to you to obtain information or access is not transferable.

10. Links to Other Websites.

a. This Website may contain links to certain third-party sites. We do not operate or control those sites or the services or products they provide. You use those sites and the services at your own risk. IN ACCORDANCE WITH PARAGRAPHS 12 AND 13 BELOW, WE DISCLAIM ALL warranties, liabilities and damages in connection with your use of such linked sites.

b. This Site may also contain links to  Organizations and others sites  like YouTube, Facebook, Linkedin,  and organization/project websites. TN makes no claims as to endorsement by links which are provided as a service convenience to TN users. You should make sure to review the Privacy and Legal Statements that specifically apply to those sites.

11. Term, Renewals, and Termination.

a. Term. This Agreement shall begin on the date of submission and continue for a period of one year.

b. Termination. Either party may terminate this Agreement at any time for any reason. Upon termination or expiration, User and  members shall no longer have access or license to use the User Services. Paragraphs 3, 4, 7, 8, 11(b), 12, 13, 14, 15, 16, and 17 shall survive termination of this Agreement.

12. DISCLAIMERS; EXCLUSION OF WARRANTIES; EXCLUSION OF DAMAGES; LIMITATION OF LIABILITY.

a. THIS WEBSITE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY WARRANTY WHATSOEVER.

b. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ALL WARRANTIES, EXPRESS OR IMPLIED, (INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT) OF ANY OF THE DATA IN THE WEBSITE, OF DATA LINKED TO THE WEBSITE, OR OF SERVICES, PRODUCTS OR INFORMATION PROVIDED, ARE DISCLAIMED.

WITHOUT LIMITING THE ABOVE, TN SHALL HAVE NO LIABILITY FOR RELIANCE ON INFORMATION ACCESSED THROUGH THE WEBSITE OR BY ANY OTHER MEANS, AND WHILE TN TAKES STEPS TO PRESENT ACCURATE INFORMATION WE MAKE NO PROMISE THAT THE INFORMATION IS ACCURATE. g. THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE AGREEMENT BETWEEN TN AND YOU, THE USER. WE WOULD NOT PROVIDE THESE SUBSCRIPTION SERVICES AND WEBSITE WITHOUT SUCH LIMITATIONS.

13. Limitations of Remedies

a. YOUR SOLE REMEDY IF YOU HAVE A CLAIM BECAUSE OF YOUR USE OF THESE SUBSCRIPTION SERVICES AND WEBSITE IS TO STOP USING THE SERVICES AND SITE.

b. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the previous paragraphs may not apply to you.

14. Release and Indemnity.

YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST THN, ITS SUBSIDIARIES, AFFILIATED ENTITIES, AGENTS, TRUSTEES, EMPLOYEES, DIRECTORS, OFFICERS, OR SUBCONTRACTORS ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SITE OR SUBSCRIPTION SERVICES. YOU ALSO AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THN ITS SUBSIDIARIES, AFFILIATED ENTITIES, TRUSTEES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR SUBCONTRACTORS FROM AND AGAINST, ANY AND ALL CLAIMS, LIABILITY, LOSS, DAMAGES, AND COSTS, (INCLUDING REASONABLE ATTORNEYS' FEES), ARISING FROM YOUR USE OF THE SUBSCRIPTION SERVICES AND WEBSITE.

15. Applicable Law and Location of Dispute Resolution

The Subscription Services and Website are created, controlled, and distributed by TN in the State of Indiana, USA. As such, the laws of the state of Indiana shall govern this Agreement, without giving effect to any principles of conflicts of laws. All claims and proceedings arising in connection with this Subscription Agreement shall be resolved in, and take place in Indiana.

16. Site for Use Only in the United States

This Site may only be used in accordance with all applicable laws. If you are accessing this Website from outside of the United States, you do so on your own initiative, and you are responsible to ensure compliance with the laws of the United States, (which include export control laws applicable to software), and the laws of your jurisdiction.

17. "Children's Online Privacy Protection" Act Compliance. Consent obtained; consent given.

Subscriber acknowledges that it is responsible for obtaining verifiable parental consent before allowing any child under 13 years old to participate in USER Services which include collection of personally identifiable information. TN may rely on the presumption that Subscriber has obtained the necessary consent, or if applicable, gives such consent by entering into this Agreement.

18. Refund Policy.

If you are not reasonably satisfied with the USER Services you receive, you may give us notice at the following address:

We shall refund any unused portion of The Network Fees you have paid during the applicable Term. This Paragraph 18 sets forth your exclusive right to refund and return.

19. Privacy Statement

When you use The Network Services and Website, certain information will be collected. Our Privacy Policy will be posted on the website and sets out the how personal information is collected and used. The Privacy Policy terms apply to your use of Subscription Services and the Website, unless they are inconsistent with this Agreement, in which event this Agreement shall control.

20. Changes to this USER Agreement

We may make changes to the website and related links and services provided and also to the Privacy Policy and Terms of Use. You should periodically review these. We shall deem your continued use of the Website and Subscription Services your acceptance to any such changes.
